Bayonne is one of 24 tension-zone communes in the Communauté d'Agglomération Pays Basque. Mandatory registration (13-digit number). Change of use with mandatory compensation for secondary residences since March 1, 2023 (CA Pays Basque règlement, amended September 27, 2025). Bayonne is in a tension zone (CA Pays Basque). Since March 1, 2023, any change of use of a dwelling to a tourist rental requires authorization with mandatory compensation: transforming a non-residential space (office, retail, warehouse) into housing of at least equivalent surface in the same commune. Règlement voted July 9, 2022 by CA Pays Basque, amended September 27, 2025. DPE requirement: the property must have an energy performance rating of A to E (classes F and G prohibited since November 21, 2024, loi Le Meur n°2024-1039 Art. 3). From January 1, 2034, only properties rated A to D will be eligible. Fine: up to EUR 100,000 per irregularly converted property.
Furnished rental income is declared under micro-BIC regime or actual expenses. Since loi Le Meur (n°2024-1039): 50% allowance for classified tourist furnished rentals, 30% for non-classified (EUR 15,000 cap). Tourist tax is collected automatically by platforms.

Obtain energy certificate
If your property is a secondary residence subject to change-of-use, obtain a DPE: minimum class E is required by loi Le Meur Art. 3. For a primary residence, a DPE is not required at registration.
Declare your income
Declare your rental income under BIC (micro-BIC or actual). Tourist tax is collected by platforms.
